These Terms of Service belongs to HackerTrail registered under the name of TechKnowledgey Pte Ltd. (“HackerTrail”, “Company”, “we”, “us” or “Owner”), a Company registered in Singapore with its business address at 100 Peck Seah Street, #08-14, S079333.
This Agreement governs your acquisition and use of our services. If you register for a free trial of our services, this agreement will also govern that free trial. By using HackerTrail’s products and cloud-based software enabled developer recruitment platform services (“Services”), you agree to the following terms and conditions, and any privacy policies and guidelines that may be presented to you (collectively these “Terms of Service”) from time to time.
HackerTrail may make available Job Ads advertising employment opportunities and other job-related content, including links to third-party websites, through HackerTrail microsites or on other channels. If you leave the HackerTrail Site and choose to enter a third-party website, you accept any terms and conditions imposed by that third party. HackerTrail has no obligation to screen any Job Ads, or to include any Job Ads, in its search results or other listings, and may exclude or remove any Job Ads from the Site or your search result for any or no reason. We cannot confirm the accuracy or completeness of any Job Ad or other information submitted by any Employer or other user, including the identity of the Employer or other user. HackerTrail assumes no responsibility and disclaims all liability for the content, accuracy, completeness, legality, reliability, or availability of any Job Ads and Company microsites.
By uploading Your Resume on HackerTrail, you are requesting and authorizing HackerTrail to make available Your Resume to third parties, such as Employers, that HackerTrail believes may have an interest in Your Resume. HackerTrail reserves the right to attach your Assessment scores as obtained on the hackertrail.com as well as any information gathered as part of your engagement with a HackerTrail employee to be included as part of your resume.
By creating a HackerTrail Resume or uploading a file resume on HackerTrail, HackerTrail may share with you Job Ads that match the contents of Your Resume. The entire information on your Resume will be shared with relevant Employers.
If you have a HackerTrail Account, HackerTrail may also automatically send you recommended jobs via the email address you use to create a HackerTrail account or apply to a job. HackerTrail may determine what these recommended jobs are on the basis of a variety of factors, including but not limited to, any information you input on the Site about yourself (including in Your Resume), searches you run on the Site, jobs you click on or apply to through HackerTrail.
Any resume or application information that you submit through the Site, including Personal Data included in a resume, application or responses, technical assessments, is subject to this Agreement and to HackerTrail’s Privacy Policy. Once you provide information to the Employer, HackerTrail does not have control over Employer’s use or disclosure of that information.
When you agree to apply for a Job through HackerTrail, sometimes Employers would want Your Resume uploaded on their Applicant Tracking Systems (ATSs). You agree that HackerTrail can upload Your Resume on the Employer ATS as part of completing your job application to the Employer. We cannot vouch for the technical capabilities of any third-party sites, including but not limited to ATSs.
When you view, send, store, or receive materials (including Job Listings, resumes, messages, questions and responses in applications, scores of online tests, dashboard feature) through or using the Site, HackerTrail may, for example, use such materials for data analysis, quality control, or to refine the Site or any other HackerTrail product or service.
HackerTrail may enable chatbots, which allows you to take certain actions on the Site, such as apply to a job, schedule an interview, or otherwise interact with the Site (“Chatbot”). You understand that the Chatbot is an automated service that does not involve human interaction. It is your responsibility to ensure the accuracy and completeness of information submitted through the Chatbot. HackerTrail is not responsible for any loss, damage or inconvenience arising because of the use (or inability to use) the Chatbot from the information you submit via the Chatbot.
Employers may offer you the opportunity to participate in virtual remote communications using HackerTrail products or third-party products but not limited to, HackerTrail Recruitment Events, online tests with webcam, virtual meetings, webinars, and video interviews (“Virtual Interviews”).
You understand that HackerTrail is not a telecommunications service provider and that HackerTrail is only providing the option for you to communicate with Employers via services that may be offered by third-party providers. We cannot vouch for the technical capabilities of any third parties to receive, transmit, or support such phone or video communications. HackerTrail is not liable for any claims arising out of your use of Virtual Interviews and you release HackerTrail from any such claims.
You understand and agree that there is no protection for any information you share or data that you transmit while participating in Virtual Interviews, including but not limited to, audio/visual content, interview questions and answers etc. HackerTrail is not responsible for securing or protecting any data or information that you share or transmit during your use of Virtual Interviews. HackerTrail assumes no liability for the misuse of any data that you share or transmit during or through the use of Virtual Interviews.
HackerTrail Assessments is an online tool for the provision and review of skill assessments selected by the Employers and responses from the Job Seekers through the Site. After you provide a Response, the Employers will be able to use the HackerTrail Assessments platform to review the Response. Receiving or responding to and Assessment does not guarantee a job or job offer, or any further communication action by an Employer. An Employer is the sole party to determine whether a Response indicates a qualified Job Seeker. The Employer is the sole party to determine whether to consider any retaken Assessments as part of their hiring process.
You agree and acknowledge that the usefulness and value of Assessments and Responses depend on their contents being kept confidential. You therefore agree to keep the content of Assessments and Responses confidential and to not reproduce or discuss them with anyone. In order to preserve the authenticity of the Assessments, HackerTrail does deploy a number of security measures such a IP detection, plagiarism checkers, and a web-cam recording. HackerTrail reserves the right to share any candidate specific findings from the above security measures to the Employer requesting the Assessments.
HackerTrail may also offer you to select an Assessment independent of a particular job, and your Response will be associated with your HackerTrail Profile.
The following terms and conditions apply to all Employers and other users who access or use the Site as intended for individuals and/or organizations seeking to make available information regarding employment openings, or otherwise indicate their acceptance to this Agreement.
When you create a HackerTrail account, a Company Page or post job listings advertising employment opportunities and other job-related content, including links to third-party websites on the Site, you agree that this Agreement, the terms associated with any HackerTrail service you are using, including the HackerTrail Privacy Policy, apply to you.
As an Employer, your account is for business use and not for personal use. HackerTrail is not responsible for and disclaims all liability if your email is used improperly or falsely by a third party.

When a Company Page is created, you understand that HackerTrail may display publicly available information about your Company on the Company Page, in accordance with applicable law.
The Site contains links to other sites on the Internet which are owned and/or operated by third-party vendors and other third parties (“External Sites”). You acknowledge that HackerTrail is not responsible or liable for any such third parties or for the availability of, or the materials located on or through any External Sites.
When you use our Site, you agree to HackerTrail knowing, processing, analyzing any and all activities you take on the Site including but not limited to which content you view, which information you input, how you interact with our Site, time spent on each activity etc.
Some parts of the Site, such as message boards and forums, practice and prep modules, may allow users to post content in any format. Such functionality is designed to enhance user communication. User Content may be misleading, inaccurate, or incomplete. You acknowledge that by accessing the Site, you may come into contact with content (including User Content) that you find harmful, offensive, threatening, indecent or objectionable, including but not limited to, explicit language and other potentially offensive material and you acknowledge that HackerTrail shall have no liability with respect to such content.
You must not post User Content that is unlawful, defamatory, fraudulent, racial or other discriminating slurs or that contains no relevant or constructive content. You must not post User Content that contains proprietary information or encourages or causes spamming or flooding.
The right to remove any User Content remains at the sole discretion of HackerTrail.
Some areas of the Site, including areas that may permit you to set up a HackerTrail account, require you to register or provide an email address. If you so register, you agree to provide accurate and complete information. You are responsible for the confidentiality of your username and password.
HackerTrail does not permit copyright infringing activities through the HackerTrail service and reserves the right to terminate access to the HackerTrail service and remove all content submitted by any persons who are found to be repeat infringers. Any suspected fraudulent, abusive, or illegal activity that may be grounds for termination of your use of the HackerTrail service may be referred to appropriate law enforcement authorities. We reserve the right to remove Content alleged to be infringing or otherwise illegal without prior notice and at our sole discretion.
Unless terminated by the Company, this Agreement will remain in full force and effect while you use any of the Services. You may terminate this Agreement at any time by requesting for deleting all the Content and ceasing to use the Services.

This Agreement will be governed as to all matters, including, but not limited to the validity, construction and performance of this Agreement, by and under the laws of Singapore.
We reserve the right, in our sole discretion, to change, modify, add, or remove portions of this Terms of Service at any time. Any changes or updates will be effective immediately upon posting to this page. We encourage you to periodically review this page for the latest information on our Terms of Service. Your continued use of our Website and Services following the posting of any changes to this Terms of Service means you consent to such changes.

Your preferences in receiving marketing from us and our third parties and your communication preferences. If you correspond with us by email or messaging through the Services, we may retain the content of sucj messages and our responses.
Behavioral Data
Inferred or assumed information relating to your behavior and interests, based on your online activity. This is most often used for user segmentation.
Technical Data
Internet Protocol (IP) address, your login data, browser type and version, time zone setting and location, operating system and platform, webcam usage and other technology on the devices you use to access this website or use our services.
Personal Data from Third Party Sources: In addition to the Personal Data that we collect directly from you, we may also collect certain of your Personal Data from third party sources, typically from social media sites.
No Special Categories of Personal Data: We do not collect any “Special Categories of Personal Data” about you (this includes your religious or philosophical beliefs, sexual orientation, political opinions, information about your health etc.). HackerTrail may collect non-personally identifiable information regarding your usage of the Services, including the pages and articles and presentations you viewed, time spent using certain features of the websites, and other information that does not identify you. Like most online services, we also use cookies, log files, tracking pixels, and other technologies that may collect Personal Data.

HackerTrail Community
If you are a HackerTrail Community member, we may list your username on a dashboard if you participate in an online assessment, tournament, hackathon, webinar etc.
Potential Employers
If you are a potential candidate who has applied to a job with a potential employer, then your information can be shared with potential employers or tournament sponsors.
Service Providers
Our Service Providers provide us support for our Services including, for example, website and application development, hosting, maintenance, backup, storage, compliance services which may require them to access Personal Data about you.
Legal, Tax, Regulatory and Judicial Authorities
HackerTrail may disclose your Personal Data if we believe it is reasonably necessary to comply with a law, regulation, audit, to address fraud, security or technical issues, or to protect our legal rights and interests.
API Users
A limited number of partners have API access to portions of the Website and Services.
In addition, Personal Data you choose to add to your profile will be available for public viewing based on the
HackerTrail Service you use, especially if it’s the Community platform. We will do our best to limit disclosure within
the Service, but we cannot promise no one else will see your information in the Service, nor do we control what
users who are allowed to see your information will do with it.
We will retain your information as long as your account is active, or it is reasonably needed for the purposes set out in Usage of Data Collected unless you request that we remove your Personal Data. We will only retain your Personal Data for so long as we reasonably need to use it for these purposes unless a longer retention period is required by law or for regulatory purposes. This may include keeping your Personal Data after you have deactivated your account for the period of time needed for us to conduct audits, comply with legal obligations, demonstrate compliance with regulatory authorities, resolve disputes and enforce our agreements.
You are entitled to know whether we hold information about you and, if we do, the type of information, the purposes for which we hold it, the possible recipients, or types of recipients, and to have access to that information and require it to be corrected if it is inaccurate. You can do this by sending us an email at support@hackertrail.com. Upon written request and within 30 days we will correct, delete and/or block personal information from further processing. We will retain your information as needed to provide you services and will retain and use your information as necessary to comply with our legal obligations, resolve disputes and/or enforce our agreements.
The Data are processed and stored in the servers based in Singapore. Although we welcome users from all over the world, by accessing the Services and providing us with your Personal Data, you consent to and authorize the export of Personal Data to Singapore and its storage and use as specified in this Privacy Policy. Note the laws of Singapore might not be as comprehensive or protective as laws in the country where you live.
Because the Services are maintained in Singapore, we do not transfer Personal Data from the EU to any parties located outside the EU. (European Union)
HackerTrail uses industry standard and technical safeguards to preserve the integrity and security of your personal information. We limit access to your Personal Data to those employees and other staff who have a business need to have such access. All such people are subject to a contractual duty of confidentiality. We cannot, however, ensure or warrant the security of any information you transmit to HackerTrail or guarantee that your information on the Services may not be accessed, disclosed, altered, or destroyed by a breach of any of our physical, managerial, or technical safeguards.
We have put in place procedures to respond to any actual or suspected Personal Data breach. In the event that personal information is compromised as a result of such breach of security, HackerTrail may promptly notify those persons whose personal information has been compromised by sending an email to you.
HackerTrail cannot ensure that your Personal Data will be protected, controlled or managed pursuant to this Privacy Policy if you share your login and password or OTP information with any third party operating a website or providing other services.
This Privacy Policy applies only to the Services. The Services may contain links to other websites not operated or controlled by HackerTrail. We are not responsible for the content, accuracy or opinions expressed in such websites and these websites are not monitored or checked for accuracy or completeness by us.
